Android’s ad-tracking code is illegal. According to Engadget, the European privacy group Noyb makes this complaint. Ironically, this group is the same one that blasted Apple’s methods as well. The group is filing a complaint with France’s Data Protection Authority. Which accuses Google of violating the EU’s “Cookie Law”.
The complaint specifically targets Google’s Android Advertising Identifier or AAID. The AAID is automatically created by Google and users can not delete it. Due to this Noyb is saying that it violates European rules requiring “informed and unambiguous” permission.
Now a user can reset their AAID. However doing this does not eliminate past data, nor does it keep advertisers from tracking you via the new ID. Noyb filed these complaints in France, but the group says that all Android phones are likely affected.
Privacy campaigner Max Schrems chairs the group. The group is hoping that France will make Google take action quickly. The EU’s e-Privacy directive is what Noyb’s complaint it built upon. As a result, the authorities will not have to cooperate.
Google could be looking at a “substantial” sanction according to Noyb. Of course, there is no guarantee that this complaint will lead to what Noyb wants. But, Schrems has a track record of success in getting results. In fact, he is one reason why the EU-US Privacy Shield fell apart.
Now there is reason to believe that Noyb may succeed. As a result, Google may find itself being forced to either offer more control over user’s AAID or scrap the technology. If that happens then advertisers will be left without a tool to track users. However, for all the privacy-conscious users this would be welcome news.
Google is no stranger to finding itself in legal trouble. Especially, over the past few years. The company is the power behind Android which is an amazing mobile OS. However, because Android is free for any and everyone to use Google has to make money somehow.
The search giant is no stranger to getting in trouble for its privacy policies before. However, the company is not he only one finding itself in trouble when it comes to privacy. Facebook and Twitter are in the same boat.
But, despite this Google has some positive things to focus on. News that the company will be using its own custom chip in the upcoming Pixel 6 is welcome news for all Pixel lovers. With this in mind, there is no guarantee that Noyb will succeed in its goals. As a result, it will be easier to focus on the more positive things that Google has on the horizon.
